PerflyMax Terms of Service

2. Eligibility and accounts

• You must provide accurate, current, and complete account information.
• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for activity carried out through your account or workspace.
• If you act on behalf of a company, agency, or client, you represent that you have the authority to do so.

3. Acceptable use

• You may use PerflyMax only for lawful business purposes.
• You may not attempt unauthorized access, interfere with service integrity, reverse engineer protected systems, or misuse APIs or credentials.
• You may not use PerflyMax to misrepresent your identity, collect data without authorization, or violate the rights of others.

4. Third-party integrations

PerflyMax may connect to services such as Google Ads, Meta Ads, TikTok Ads, and other third-party platforms. Your use of those services remains subject to their own terms, policies, and technical limits.

We are not responsible for third-party outages, API changes, permission revocations, or platform-side account restrictions.

5. Data and privacy

Our collection and use of personal data and Google user data are described in the Privacy Policy.

You are responsible for ensuring that you have the rights and permissions needed to connect accounts and make data available through PerflyMax.

6. Intellectual property

• PerflyMax and its service materials, software, and branding remain the property of PerflyMax or its licensors.
• You retain rights in the data and content you provide, subject to the limited rights required for us to operate the service.
• These terms do not transfer ownership of PerflyMax intellectual property to you.

7. Availability and changes

We may update, improve, suspend, or discontinue features from time to time. We aim to keep the service available, but uninterrupted or error-free operation is not guaranteed.

8. Disclaimers and limitation of liability

• PerflyMax is provided on an "as is" and "as available" basis to the extent permitted by applicable law.
• To the extent permitted by law, PerflyMax is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
• To the extent permitted by law, our total liability arising from the service will not exceed the amount paid to PerflyMax for the relevant service period giving rise to the claim.

9. Suspension and termination

We may suspend or terminate access if necessary to protect the service, comply with law, respond to security concerns, or address material violations of these terms.
